A Brewerton car dealer is accused of stealing from his customers. The Onondaga County Sheriff’s Department says Anthony Spinella, the owner of Spinella’s Auto Sales, would accept a vehicle trade-in with the understanding that he would pay off the customer’s existing lien. But deputies say, Spinella never followed through on those payments and then sold the cars.

Minnesota Car Dealer Pleads Guilty to Fraud

St. Paul, Minn. — Denny Hecker, once one of the Twin Cities biggest car dealers, pleaded not guilty Thursday to new fraud charges alleging he tried to rip off lenders and hide assets in bankruptcy.

Hecker was arraigned in U.S. District Court on 18 new counts of wire fraud and bankruptcy fraud.

Hecker previously pleaded not guilty to seven fraud and money laundering charges. Hecker attorney Bill Mauzy says the government is trying to cast rough-and-tumble but legitimate business deals as frauds.

San Diego Car Dealer Fraud Against Sailor

Among the greatest consumer financial threats faced by members of the armed forces are unscrupulous automobile sales. David Julian, the director of the Office of Personal Finance at the Defense Department, was at Thursday’s meeting at the Treasury.

“With our troops being very young, primarily their largest financial obligation that they have is a vehicle,” he said. “And since they do have a guaranteed paycheck; they do have other benefits, it could make them an attractive target for harmful practices.”

Those shady practices include bait-and-switch financing and falsification of loan documents — scams even lots of older consumers fall victim to.

Toyota Calls into Doubt Prius Case

Toyota on Monday released information that calls into question a driver’s account of uncontrollable acceleration affecting his Toyota Prius in San Diego.

In a video released Monday by Toyota titled “Toyota preliminary findings of alleged runaway Prius,” Toyota Motor Sales Vice President Mike Michels questioned Jim Sikes’ account of uncontrolled acceleration in his Prius last week in San Diego.

Toyota Accelerator Pedal and California Lemon Law

A Sacramento, California-based consumer advocacy group called CARS (Consumers for Automobile Reliability and Safety) is arguing that Toyota Motor Corporation should buy back models with the highly-publicized unexpected acceleration problem as lemon law buy-backs. So far, Toyota has not taken this measure with their customers, instead urging them to bring the affected cars to dealerships where they will be repaired.

Rosemary Shahan, president of CARS and a nationally known advocate for vehicle owners’ rights stated that consumers who have experienced the horror of unexpected acceleration should not be subjected to repeat experiences, but should instead be offered a refund by the manufacturer.

Mercedes-Benz hit with large ‘lemon law’ judgment

MADISON, Wis. — A judge has ordered Mercedes-Benz USA LLC to pay $482,000 in damages and legal fees to a Wisconsin customer who was sold a defective car and not given a refund on time.
Vince Megna, a Milwaukee lawyer who represents the customer, said he believes the judgment is the largest involving a single car under a state “lemon law,” which protect consumers who are sold junk cars.

Wisconsin Lemon Law Motorcycle

Goudy completed a Motor Vehicle Lemon Law notice, which was provided to Yamaha Motor Corporation. Yamaha responded by notifying Goudy he had purchased a “highly modified unit” and that the warranty was not valid. Goudy then commenced this action against Yamaha, and followed that with a demand for relief to Winnebagoland under the Lemon Law.

Yamaha moved for summary judgment, arguing that the failures Goudy experienced were either the result of nonstock components, none of which were covered by Yamaha’s warranties, or the result of normal wear and tear, also not covered under warranty.

Winnebagoland also moved for summary judgment, arguing that it was not a “manufacturer” as defined under the Lemon Law, it issued no warranties for the motorcycle and it made no misrepresentations in selling the motorcycle.

My New Car If it Won’t Start? – How the California Lemon Law Helped This Man

Not being an attorney as I’ve mentioned many times before, people often ask me why I even write article about the California Lemon Law. The answer is simple. I’m a person who believes that what is right, is right, and no matter who you are, you should be part of the solution and not part of the problem.

In California right now, and in many other states in the U.S. there are laws in effect or about to be put into effect that will remedy car owners who in fact, bought themselves a lemon. I’m just one person who promotes this law in hopes that it will help people to get what they paid for and not to be stuck with a vehicle that gives them nothing but torment. That being said, many people write to me regarding their situations. This one is a case for the California Lemon Law books!

Mr. Smith, as I’ll call him, is in his 40’s and is a married man with 3 children. He’s spent most of his married life being very practical and watching every penny that came into his home. On the 20th anniversary of his marriage, he and his wife decided that they were going to splurge and get something that was a bit beyond their means, but you only live once, right? They bought themselves a convertible BMW; their new toy.

When they picked up their new car from the dealership, it was an incredible day for them. The San Diego sun was shining, the convertible top was down, they were driving along the ocean and all was well with the world. The words California Lemon Law were foreign to them but soon, they would understand why they were so important.

The Smiths planned a trip up the coast for that weekend. They got sitters for the kids, had their bags packed and got in their new luxury vehicle. Mrs. Smith said she’d drive the first leg, so she got in and started the car; nothing. She tried again. The engine whirred but it wouldn’t start. Mr. Smith figuring she really didn’t know much about cars, got in the passenger seat and said that he would start it then she could get back in and drive. The California Lemon Law was not yet part of their lives, but soon would be.

Mr. Smith got in the driver’s seat and turned the key in the ignition. It whirred but didn’t turn over and start. He tried several more times. He looked under the hood. He was in total disbelief. He slammed the car door, stormed into the house and called the dealership. They were very nice and told him that they would have someone at their home to tow their vehicle to the dealership later in the day. And so the cycle began. Over the next two months, that BMW spent more time in the dealership repair shop than it did in the Smith’s driveway.

Lemon Law For Cars – Finding Information on Lemon Laws

If you have recently purchased a vehicle, and are now finding it has mechanical problems, you may have purchased what is known as a lemon. This is in simple terms a car that is not up to standards set forth by the government. There are certain laws that protect the consumer from purchasing these types of cars. It is suggested anyone thinking of purchasing a new vehicle should read up on the lemon laws for their state as well as federal guidelines. There are many places to get information on these laws. The Magnuson-Moss Warranty Act is a law that governs consumer products with warranties. The Uniform Commercial Code is another law that is good reference material to read about. The internet has a vast amount of knowledge on these laws also. Every state has their own laws also; most of these laws define exactly what is covered under them also. These laws will determine what an appropriate amount of times is for a dealer or manufacturer to try and correct the problem before action can be taken against them. Again, state by state laws vary, so do the research. A lot of the information available online will describe the state laws in depth. In many states, even if a vehicle is not covered under a law, then it may still be covered under the federal guidelines. In these instances the vehicle is still subject to the laws.

Online discussions are a good place to find information from other consumers who may have had the same problems. Although these consumers may reside in another state, so the laws there may be different than the laws in your state. In any situation a qualified lawyer should be consulted about your unique situation, even if the consumer giving you the information has described your situation as the same as theirs. Qualified lawyers can tell you the laws pertaining to your situation.

The American Association of Motor Vehicle Administrators offers help for a consumer filing a suit, and can give information on each states department of motor vehicles websites. The National Highway Traffic Safety Information will give information regarding recalls and current safety standards.

Remember if you are thinking of filing a suit under a lemon law against a manufacturer or dealer, record keeping is a must. Proper record keeping and documentation is what it will take to win a case of this nature. Manufacturers and dealers are mostly financially sound and can hire the lawyers that can win cases like this for them, without proper documentation and record keeping a consumer will inevitably fail.
